This agreement (1-10) contains the entire understanding between JC ZHEN & ASSOCIATES and the CLIENT. By paying the $500 deposit, the CLIENT agrees to these 10 terms of service, and enter into our binding contract.

1. RESERVATION for PHOTOGRAPHY and/or VIDEO: JC ZHEN & ASSOCIATES requires a $500 deposit/retainer fee by online payment to reserve the specified service for the date of the wedding. JC ZHEN & ASSOCIATES bills our service at the rate of $250 per hour, per one contracted photographer and/or one contracted videographer. JC ZHEN & ASSOCIATES bills in one hour increments. JC ZHEN & ASSOCIATES will only stay for our prepaid contracted time. JC ZHEN & ASSOCIATES require a prepaid 50% online deposit/retainer for service over four hours. Any monies/deposits received for additional time over four hours must be applied to more service time. Our $995 WEDDING PHOTOGRAPHY service and $995 WEDDING VIDEO service run parallel-IE: We start and end at the same time (4 hours). If you increase the time for one service, the other service must also be increased to match. Additional DVD or CD-ROM copies are on file for 30 days from ceremony date and are available for $250 each. CLIENT agrees that $995 WEDDING PHOTOGRAPHY is delivered with fifty-4x6 non-original prints (two hundred double prints in four hours service) from digital and/or 35mm kodak and/or fuji negatives, per hour minimum. DVD photo slideshow is delivered with U2's "Beautiful day" as the song/soundtrack- the song/soundtrack that runs approximately 5 minutes. CLIENT agrees that digital images on CD ROM are JPEG file and are from the digital camera only and are delivered at fifty images per hour minimum. CLIENT agrees that all the images and/or digital video delivered is not enhanced or retouched. JC ZHEN & ASSOCIATES charges a rate of $50 per hour to enhance (PHOTOSHOP) any image or video to CLIENT written specifications. CLIENT agrees that $995 WEDDING PHOTOGRAPHY is delivered with one wedding album. Additional wedding albums are $50 each. CLIENT agrees that $995 WEDDING VIDEO is delivered on one DVD with thirty to sixty minutes of event video. CLIENT agrees that $995 WEDDING VIDEO DVD is segmented into interviews, ceremony and reception. Video is recorded with available light and delivered without wireless/remote microphones. CLIENT agrees that $995 WEDDING VIDEO DVD may contain or be converted to black and white. CLIENT agrees that $995 WEDDING VIDEO DVD digital video tapes (raw and unedited) are an additional fee of $995 and are available for 45 (forty five) days from the event date. CLIENT agrees to pay a surcharge of $500 (five hundred dollars) for wedding dates that fall on Thanksgiving, Christmas or New Years. Availability of our contracted photographer and/or contracted videographer is limited. We are first come, first served.

2. EXCLUSIVE: JC ZHEN & ASSOCIATES shall be the exclusive professional photographer and/or professional videographer retained by the CLIENT for the purpose of professional photography and/or professional videography of the wedding. No other professional or competing photographers or videographers are permitted. Family and friends of the Client shall be permitted to photograph the wedding as long as they shall not interfere with JC ZHEN & ASSOCIATES duties.

3. CANCELLATION: CLIENT agrees that all deposits are nonrefundable for service time once received by JC ZHEN & ASSOCIATES. All deposits are nonrefundable and nontransferable if the wedding or service is canceled. The entire photography fee will be charged if an event is canceled ninety (90) days or less prior to the date of the scheduled event. There will be no refunds for inclement weather, fire, tsunami, earthquake, loss of utilities, acts of any governmental body (martial law) or acts of God.. Credit card charge back fee is $250 per action. All cancellations must be in writing, signed and dated by the CLIENT on our Cancellation of Service form.

4. EVENT INFORMATION: JC ZHEN & ASSOCIATES requires all event information and performance instructions on the "itinerary form" and "VIP-must have list" to be in writing from our CLIENTS 30 days (thirty) before the event. Our "itinerary form" document must not be altered. All documents must be electronic (not handwritten) on PDF, microsoft word, wordpad or notepad. The photography and/or video service will start at the specified "start time", and end at the specified "end time", as written by our CLIENT. JC ZHEN & ASSOCIATES will not arrive to work the event if no written event information is provided by CLIENT. CLIENT agrees to be billed in full if written event information is not provided. JC ZHEN & ASSOCIATES will phone CLIENT within the week of the event to confirm written performance instructions. CLIENT agrees to submit by email and post mail the ITINERARY or VIP-MUST HAVE. CLIENT agrees to submit by email and post mail, ceremony and/or reception maps with driving directions (start from San Francisco 94115) to JC ZHEN & ASSOCIATES. CLIENT agrees that JC ZHEN & ASSOCIATES and our contracted photographer and/or contracted videographer will not arrive to work the event and will not be held accountable, if wrong event address/zip (ceremony or reception) is submitted. CLIENT agrees to submit by email and post mail any new or revised ITINERARY or VIP-MUST HAVE or DIRECTIONS updates. Within 30 days is default. The default 35mm film is all color.

5. COMMUNICATION: JC ZHEN & ASSOCIATES and the CLIENT agree to cheerful cooperation and written communication for the best possible result within the definition of this service contract. CLIENT agrees to designate a "family liaison" (someone familiar to the bride and groom) to facilitate our formal photo session. CLIENT agrees that the default area for formal photos is the ceremony alter unless otherwise specified in writing to JC ZHEN & ASSOCIATES. CLIENT agrees that JC ZHEN & ASSOCIATES and our contracted photographer will not be held accountable for missed photos of bride, groom, bridal party, or principals if there is no written "VIP-Must have list". CLIENT is responsible for organizing, identifying and gathering people for formal "VIP-Must have list" photographs. CLIENT agrees that JC ZHEN & ASSOCIATES and our contracted photographer and/or contracted videographer will not be held accountable for not photographing desired people on the "VIP-must have list" if there is no liaison or if the liaison fails or if CLIENT fails to assist in organizing, identifying or gathering people for formal VIP photographs. CLIENT agrees that JC ZHEN & ASSOCIATES is not responsible if key VIP individuals fail to appear or cooperate for photographs or video interviews. JC ZHEN & ASSOCIATES is not responsible for missed images due to details not revealed in writing from CLIENT. CLIENT and/or DJ/MC is responsible for the organization and execution of all the events (for example: cake cutting, bouquet toss, garter toss) to be photographed during our contracted time. CLIENT agrees that our contracted photographer and/or contracted videographer receives one ten minute break per hour service. CLIENT agrees that our contracted photographer and/or contracted videographer are permitted to break and eat if offered a meal from anyone, including bridal party, venue staff or caterers. CLIENT agrees to schedule any meetings with JC ZHEN & ASSOCIATES by appointment (email confirmation reply required) during our business hours. Our San Francisco business hours are: Monday, Tuesday, Wednesday, from 12pm to 5pm. We are closed Thursdays, Fridays, Saturdays and Sundays. We are closed on major holidays. JC ZHEN & ASSOCIATES will return CLIENT phone messages and /or emails next day during our business hours. Our business phone number is 415-680-1684. Our email address is jczhen@gmail.com.. CLIENT agrees to keep JC ZHEN & ASSOCIATES original email subject line (wedding date, IE; 12/23/07) to avoid confusion in our written correspondence. JC ZHEN & ASSOCIATES business office location is 732 Presidio Ave, San Francisco, CA. 94115.

6. HOUSE RULES: CLIENT agrees that JC ZHEN & ASSOCIATES is limited by the guidelines of the ceremony official and/or reception site management. CLIENT agrees to accept the image results of their imposition on JC ZHEN & ASSOCIATES. Image imposition on JC ZHEN & ASSOCIATES might include the following: No photos, no video, no flash, no lights, no movement. Negotiation of image guidelines and /or imposition with the ceremony and/or reception officials is the responsibility of the CLIENT. CLIENT agrees to accept the image results of their verbal or written orders of imposition on JC ZHEN & ASSOCIATES.

7. COPYRIGHTS and MODEL RELEASE: Upon final payment by the CLIENT, the shared (non-exclusive) copyrights (certificate of ownership) of the resulting images will be signed (transferred) to the CLIENT. The CLIENT hereby grants to JC ZHEN & ASSOCIATES the MODEL RELEASE right to use and publish photographs of the CLIENT for editorial, trade, advertising and to copyright the same. The CLIENT hereby releases JC ZHEN & ASSOCIATES from all claims and liability relating to said photographs. CLIENT agrees that JC ZHEN & ASSOCIATES can not plagiarize and/or copy other professional photographers printed (copyrighted) work or images. The CLIENT receives every image we shoot. There are no photos or images to pick or chose, except for ONLINE WEDDING ALBUM (see line #8 for restrictions).

8. ONLINE WEDDING ALBUM : This service is free for CLIENTS who book us after 1/1/07. After final payment is received, the CLIENT must select and submit to JC ZHEN & ASSOCIATES up to 200 (two hundred) digital images (JPEG) on CD ROM within 30 day of the ceremony date. CD ROM must read on PC. CD ROM must be labeled with CLIENT name and wedding date. Web hosting is free for one year from ceremony date. Renewal of web publication is a prepaid $995 annual fee. Any CD ROM received after 30 days (postmark) from the date of the event, will be returned to CLIENT and website construction will be forfeited. Digital images to be published on the world wide web must be selected from our service. Website will be published within 90 days from ceremony date.

9. FINAL PAYMENT: JC ZHEN & ASSOCIATES accepts final payment by CLIENT or universal agent in cash only at our San Francisco office during our business hours. All sales are final after final payment is received by JC ZHEN & ASSOCIATES. Any gratuities received are nonrefundable. Prepayment is not accepted. U.S.P.S. shipping fee with insurance in USA is $100. Photos and DVD are shipped by U.S.P.S. after three business days of payment received. Our credit card company is Paypal.com. Paypal and/or credit card payment must add 15% processing fee to total balance due. Home delivery by JC ZHEN & ASSOCIATES to CLIENT in Northern California is $250. Retroactive archive fees of $50 per month apply after 30 days of storage. After 90 days, all abandoned 4x6 photos, 35mm negatives, DVD, CD ROM, DV tapes will be discarded and all monies/deposits will be forfeited. Photography will be ready after 2 weeks from ceremony date. Video-DVD will be ready after 4 weeks. Rush fee (pickup before two weeks) is 100% of total bill. JC ZHEN & ASSOCIATES will send an email bill to CLIENT upon completion. CLIENT agrees to email delivery instructions and/or schedule pick-up and final payment appointment and await our appointment confirmation reply by email. CLIENT agrees that photos and DVD will be released after final payment is received by JC ZHEN & ASSOCIATES.

10. LIMIT OF LIABILITY and AGREEMENT: CLIENT agrees that JC ZHEN & ASSOCIATES can replace the contracted photographers and/or contracted videographers at our discretion. In the event that the contracted photographers and/or contracted videographers are unable to work the date of the event due to acts of God , auto accident, illness, or injury, JC ZHEN & ASSOCIATES will issue a full refund of deposit to the CLIENT. The CLIENT agrees that our liability is limited to the return of all deposits/payments received for the event package. In the event that photographs and/or video have been lost, stolen, or destroyed for reasons within or beyond JC ZHEN & ASSOCIATES control, JC ZHEN & ASSOCIATES liability is limited to the return of all deposits/payments received for the event package only. By paying the $500 deposit, the CLIENT agrees to these 10 terms of service, and enter into our binding contract.

You can book Photography online now with a $500 retainer/deposit. *Please note- We are now booking for 2010. Also, our availability is limited, as we shoot only one wedding per day. We can meet, by appointment, to review more samples of our work at our studio in San Francisco. Our San Francisco studio hours are: Monday, Tuesday, Wednesday, from 12pm to 5pm.
